The following Terms & Conditions govern the use of the EUMAP website ("EUMAP website" or "this site"), which is maintained by the Open Society Institute (“OSI”). By visiting EUMAP’s website, you specifically and automatically agree to abide by these Terms & Conditions. OSI and/or EUMAP reserve the right to modify these Terms & Conditions at any time. Your continued use of this site following the posting of any changes to these Terms & Conditions shall mean that you have accepted the changes in their entirety.

Use of Materials on this Site

In keeping with EUMAP’s goals and mission, many of the materials posted on this website, except for those that contain a copyright notice for a third party other than OSI or EUMAP, are licensed to the public through the Creative Commons Attribution-Non-commercial-No Derivatives license. This license allows users to download the materials from this website (that are not specifically restricted or indicate copyright belongs to a non-OSI party) and to share them as long as: 1.the particular article, section or video is reproduced in its entirety in its original form and is not edited or modified in any way; 2. all copies include attribution to the original author (if noted) and the Open Society Institute and/or EUMAP and contain a link back to this site as the original source of the work; and 3. the copies are distributed only for noncommercial educational or public policy purposes and are distributed at no charge.

Other than as specifically described in the preceding paragraph, you may not copy, reproduce, distribute, modify, display, republish, transmit, repost, or otherwise use the content on our website without prior written permission from the Open Society Institute or EUMAP. To request such permission, please contact us. The names “EUMAP”, “Open Society Institute,” OSI’s swirl logo, and all related indicia are the trademarked properties of EUMAP and the Open Society Institute respectively, and in no event may they be reproduced separately from the textual content associated with them on this website.

OSI works to maintain the privacy of any personally identifiable information (name, mailing address, email address, etc.) that may be collected though our websites, including this site. Please note, however, that, though this site has security measures in place, OSI and EUMAP do not represent, warrant, or guarantee that personal information will be protected against unauthorized access, loss, misuse, or alterations. Similarly, OSI and EUMAP disclaim liability for personal information submitted through this or any other OSI website. Users are hereby advised that they submit such personal information at their own risk.

Digital Millennium Copyright Act

If you are a copyright owner or an agent thereof and believe that any content posted by a user of this site infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
• Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

EUMAPs designated Copyright Agent to receive notifications of claimed infringement is: Andrea Gurubi (agurubi@osi.hu). You acknowledge that if you fail to comply with all of the requirements of this Section, your DMCA notice may not be valid.

Counter-Notice. If you believe that your posting that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content in your posting, you may send a counter-notice containing the following information to the Copyright Agent:

• Your physical or electronic signature;
• Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
• A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
• Your name, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the federal court in New York, New York, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, OSI and/or EUMAP may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.

Release and Indemnity

For good and valuable consideration, the receipt and sufficiency of which you acknowledge by your entry to this website or participation in or posting to any Forum, you hereby agree to release and waive any and all claims and/or liability against the Open Society Institute, EUMAP and their current and former trustees, officers, staff, consultants, and agents, if any, arising from or in connection with your use of this site. You also agree to indemnify and hold harmless OSI, EUMAP and their current and former trustees, officers, staff, consultants, and agents, if any, from and against any and all actual or potential costs, fees, damages, assessments, penalties, sums, or amounts of any kind or nature whatsoever, including, without limitation, attorneys’ fees, arising from or in connection with your use of this site or failure to abide by applicable law.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, U.S.A. applicable to contracts to be fully performed within that State. Any dispute arising from these Terms and Conditions shall be finally resolved by the courts of the State of New York, United States of America. Venue of any court proceeding related thereto shall lie exclusively within the Borough of Manhattan, City of New York.
